Terms of Service

LoadBid is an online marketplace operated by the operator of LoadBid. LoadBid connects customers who need transport services ("Customers") with independent transport providers ("Carriers") operating in Australia. LoadBid provides listing and messaging services only.

The transport contract for each job is between the Customer and the accepted Carrier. LoadBid is not a party to that contract and is not a carrier, freight forwarder or insurer.

By creating an account, posting a load, submitting an offer, accepting a job, or otherwise using LoadBid you agree to these Terms of Service, our Privacy Policy and the Cancellations & Disputes policy. If you do not agree, do not use the service.

• You must be at least 18 years old and legally able to enter into a contract.
• You must provide accurate information and keep it up to date.
• You are responsible for activity that occurs under your account.
• Carriers must complete verification before they can accept jobs.
• LoadBid may suspend or terminate accounts that breach these terms, that behave in an unsafe or fraudulent way, or that fail verification.

LoadBid provides the technology to advertise loads, exchange offers, communicate and accept jobs. LoadBid does not warrant that any listing, offer or profile is accurate, does not guarantee any particular outcome, is not a party to the transport contract, and does not process, hold or refund money exchanged between Customers and Carriers.

• Only post loads you own or are legally authorised to move.
• Provide accurate item descriptions, dimensions and weight.
• Disclose access conditions, loading requirements and any special handling.
• Declare any dangerous, regulated or high-value goods.
• Be available at agreed times for pickup and delivery.
• Do not post prohibited items (see clause 7).

• Maintain accurate business, licensing, registration and insurance information.
• Use vehicles that are suitable, roadworthy and correctly registered.
• Hold current insurance appropriate to the work you accept.
• Hold licences, accreditations and permits required for the loads you carry.
• Load, secure and transport goods safely and lawfully.
• Meet Chain of Responsibility (CoR) and heavy-vehicle obligations that apply.
• Remain responsible for any subcontractors you engage.
• Manage your own tax obligations, including GST where applicable.
• Comply with all applicable Australian laws and regulations.

The following must not be posted, quoted or transported through LoadBid:

• Illegal goods, stolen property or the proceeds of crime.
• Explosives, ammunition or firearms outside lawful transport arrangements.
• Dangerous or hazardous goods that have not been correctly declared.
• Hazardous waste, asbestos or other regulated waste without lawful handling.
• Unlawful wildlife products.
• Human remains, other than through a lawful funeral or medical arrangement.
• People, or live animals outside licensed livestock transport arrangements.
• Misleading listings, harassment, account sharing, false verification documents, or any attempt to circumvent LoadBid's rules.

LoadBid is currently a free marketplace. Creating an account, posting a load, submitting an offer, accepting a job and messaging on-platform are all free. LoadBid does not charge commissions, lead fees or subscription fees.

LoadBid is not a party to any arrangement between a Customer and a Carrier for the transport work itself. Anything exchanged between the parties for the job is arranged and settled directly between them; LoadBid does not collect, hold, release or refund it, and does not issue invoices or receipts on their behalf.

Cancellation and dispute processes are set out in the Cancellations & Disputes policy, which forms part of these terms. In summary:

• Before a carrier is accepted: the load can be cancelled at any time with no obligation to any carrier.
• After a carrier is accepted, before pickup: message the carrier as early as possible and agree how any deposit is handled between yourselves.
• After the carrier has commenced pickup or transit: any settlement is arranged directly with the carrier based on work already performed.
• Carrier cancels before pickup: the customer is released from the job; repeat cancellations may affect the carrier's loadbid account.
• Carrier no-show or failed pickup: the customer is released from the job and may raise a dispute on loadbid.

LoadBid may facilitate resolution but is not a legal arbitrator; parties may need to resolve serious disputes between themselves or through the courts.

Reviews are held privately for up to 14 days after a job is completed and then published together. You must only submit reviews that are accurate, based on your own experience, and lawful. LoadBid may hide or remove reviews that breach these rules.

You retain ownership of the content you post to LoadBid. You grant LoadBid a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute that content solely as needed to operate, secure and promote the service.

LoadBid relies on third-party infrastructure providers for hosting, the database, authentication and file storage. Their terms and privacy notices apply to the parts of the service they power.

To the maximum extent permitted by Australian law, LoadBid is not liable for indirect or consequential loss, loss of profits, or loss arising from a Carrier's or Customer's own acts or omissions. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law that cannot lawfully be excluded. Where LoadBid's liability can be limited under law, it is limited (at LoadBid's option) to re-supplying the service or refunding the fees paid to LoadBid for it.

We may update these terms from time to time. Material changes will be notified via the site or by email. Continued use of LoadBid after changes take effect means you accept the updated terms.

This agreement is governed by the laws of the registered Australian state of the LoadBid operator, Australia. The parties submit to the exclusive jurisdiction of the courts of that state.
