Terms of Service

This page is maintained by the operator of LoadBid to describe how the marketplace works. It is a template based on the platform's current features and is provided for information only. It is not legal advice — please have a qualified Australian lawyer review it before you rely on it commercially.

1. About LoadBid

LoadBid is an online marketplace that connects customers who need transport services ("Customers") with independent transport providers ("Carriers") operating in Australia. LoadBid is not a carrier, freight forwarder, or party to the transport contract between a Customer and a Carrier.

2. Accepting these terms

By creating an account, posting a load, submitting a bid, or otherwise using LoadBid you agree to these Terms of Service, our Privacy Policy, and any additional rules published on the site. If you do not agree, do not use the service.

3. Accounts

  • You must be at least 18 years old and legally able to enter into a contract.
  • You must provide accurate information and keep it up to date.
  • You are responsible for activity that occurs under your account.
  • Carriers must complete verification (ABN, insurance and ID) before bidding.
  • LoadBid may suspend or terminate accounts that breach these terms, that behave in an unsafe or fraudulent way, or that fail verification.

4. Marketplace role

LoadBid provides the technology to advertise loads, exchange bids, communicate, accept jobs and process payments. The transport contract itself is directly between the Customer and the Carrier. LoadBid does not warrant that any listing, bid or profile is accurate, and does not guarantee that a job will be completed.

5. Posting a load (Customers)

  • Only post loads you are legally entitled to move.
  • Provide accurate details about the item, weight, dimensions, dates and any dangerous goods, oversize or refrigerated requirements.
  • Do not post loads that are illegal to transport, that include prohibited items, or that involve people or live animals.
  • Do not post the same load repeatedly to attract lower bids.

6. Bidding and jobs (Carriers)

  • Only bid on loads you can legally, safely and lawfully carry with the vehicle and insurance you nominate.
  • Bids are binding offers. If your bid is accepted, you must complete the job.
  • Keep your ABN, insurance and vehicle records current. LoadBid may revoke verification if documents expire.
  • You are solely responsible for compliance with all applicable Australian road, transport, work health and safety, tax and heavy-vehicle regulations.

7. Fees and payments

  • Posting a load and submitting a bid are free.
  • When a bid is accepted, LoadBid charges a platform fee of 5% (500 basis points), calculated on the accepted price and included in the amount the Customer pays.
  • Payments are processed by Stripe. By using LoadBid you also agree to Stripe's terms of service.
  • The carrier's share is released 24 hours after delivery is confirmed, provided no dispute is open at that time.
  • Amounts shown on the site are in Australian dollars and include GST unless indicated otherwise.

8. Cancellations, disputes and refunds

Either party may cancel a job before pickup subject to fair-use rules. If a job is cancelled after acceptance, LoadBid may refund the Customer, retain fees, or hold the carrier payout depending on the circumstances. Disputes may be raised from the job page. Where LoadBid can, it will mediate — but it is not a legal arbitrator and parties may need to resolve serious disputes through the courts.

9. Reviews and ratings

Reviews are held privately for up to 14 days after a job is completed and are then published together. You must only submit reviews that are accurate, based on your own experience, and lawful. LoadBid may hide or remove reviews that breach these rules.

10. Prohibited conduct

  • Do not circumvent the platform to avoid fees.
  • Do not harass, threaten or discriminate against other users.
  • Do not misrepresent your identity, business, insurance or vehicle.
  • Do not use LoadBid for money laundering or any unlawful activity.
  • Do not attempt to breach, probe, or overload the platform's security.

11. Content you provide

You retain ownership of the content you post to LoadBid. You grant LoadBid a worldwide, non-exclusive, royalty-free licence to host, store, display and distribute that content solely as needed to operate and promote the service.

12. Third-party services

LoadBid relies on third-party services including Stripe for payments and Supabase for hosting and authentication. Their terms and privacy policies apply to the parts of the service they power.

13. Disclaimers and liability

The service is provided on an "as is" and "as available" basis. To the extent permitted by Australian law, LoadBid disclaims all implied warranties. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law. Where LoadBid's liability cannot be excluded, it is limited (at LoadBid's option) to re-supplying the service or refunding the fees paid for it.

14. Changes

We may update these terms from time to time. Material changes will be notified via the site or by email. Continued use of LoadBid after changes take effect means you accept the updated terms.

15. Governing law

These terms are governed by the laws of Australia and the state in which the LoadBid operator is registered. The parties submit to the exclusive jurisdiction of the courts of that state.
